1. Introduction
These Terms and Conditions ("Terms") govern your use of the TechPort customs declarations platform ("Service") operated by TECHPORT TECHNOLOGIES LTD ("we", "us", "our"), a company registered in England and Wales.
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
2. Service Description
TechPort provides a software platform that enables users to prepare, validate, and submit customs declarations to HM Revenue & Customs (HMRC) via the Customs Declaration Service (CDS) API. The Service includes:
- Document processing and data extraction
- Customs declaration form preparation
- Electronic submission to HMRC
- Status tracking and response management
- Declaration history and reporting
3. Account Registration
To use the Service, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised access
- Ensuring your contact information remains current
We reserve the right to suspend or terminate accounts that violate these Terms or remain inactive for extended periods.
4. Trial Period
New users are entitled to a trial period allowing the submission of up to 10 customs declarations at no charge. This trial enables you to evaluate the Service before entering into a commercial agreement.
Trial declarations are subject to the same terms and conditions as paid submissions. We reserve the right to modify or discontinue the trial offering at any time.
5. Pricing and Payment
Following the trial period, use of the Service requires a commercial agreement. Pricing is determined on an individual basis, taking into account factors such as:
- Expected declaration volume
- Complexity of customs operations
- Required support level
- Contract duration

6. User Responsibilities
When using the Service, you agree to:
- Provide accurate and complete information in all declarations
- Comply with all applicable customs laws and regulations
- Maintain valid registration and any required licences
- Review declarations before submission for accuracy
- Respond promptly to HMRC queries or requests for information
- Not use the Service for any unlawful purpose
Important: You remain legally responsible for the accuracy and completeness of all customs declarations submitted through the Service. While we provide tools to assist with declaration preparation, final responsibility for compliance with customs regulations rests with you.
7. HMRC Submissions
The Service submits customs declarations to HMRC on your behalf using the CDS API. By using the Service, you authorise us to:
- Submit declarations to HMRC using your credentials and authorisations
- Receive and process HMRC responses on your behalf
- Store declaration data as required for record-keeping
We do not guarantee HMRC acceptance of any declaration. Rejections, queries, or penalties imposed by HMRC are your responsibility to address.
8. Service Availability
We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance (with advance notice where practicable)
- HMRC system outages or maintenance
- Technical issues beyond our reasonable control
- Force majeure events
We will make reasonable efforts to restore service promptly and communicate significant outages through appropriate channels.
9. Intellectual Property
The Service, including its design, features, and underlying technology, is owned by TECHPORT TECHNOLOGIES LTD and protected by intellectual property laws. You may not:
- Copy, modify, or distribute any part of the Service
- Reverse engineer or attempt to extract source code
- Use our trademarks without written permission
- Create derivative works based on the Service
You retain ownership of your data. By using the Service, you grant us a limited licence to process your data solely for providing the Service.
10. Data Protection
We process personal data in accordance with our Privacy Policy and applicable data protection laws, including UK GDPR. We act as a data processor when handling customs declaration data on your behalf.
11. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability for any claims arising from use of the Service shall not exceed the fees paid by you in the 12 months preceding the claim
- We are not liable for HMRC decisions, penalties, or delays
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
12. Indemnification
You agree to indemnify and hold harmless TECHPORT TECHNOLOGIES LTD, its officers, employees, and agents from any claims, damages, or expenses arising from:
- Your use of the Service
- Inaccurate or incomplete declaration information you provide
- Your violation of these Terms
- Your violation of any applicable laws or regulations
13. Termination
Either party may terminate the agreement with 30 days written notice. We may suspend or terminate your access immediately if you:
- Breach these Terms
- Fail to pay applicable fees
- Use the Service for unlawful purposes
- Engage in activity that harms other users or the Service
Upon termination, your right to use the Service ceases. We will retain your data as required by law and our data retention policies.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
